Vidio sam u Bolu intenzivan promet bajbota od Zlatnoga rata do usidrenih brodova. Kad nema gužve, to nije strašno, ali kad malo zapuše i plaža je puna ljudi, onda nije ugodno gledati ni kupati se, jer nerijetko gumenjake s pentom voze djeca i vjetar ih kao igračke nosi preko plutača. Za upravljanje im ne treba dozvola, no zanima me je li zakonski uređen taj dio plovidbe od usidrenog broda do plaže? Bi li u takvoj situaciji morali koristiti vesla?

Ovim primjerom potaknuli ste više pitanja: kako i koliko se pomoćne brodice mogu udaljiti od matičnoga plovila, tko sve može upravljati malim gumenjacima s motorom snage do 5 kW, te koji se plovni objekti mogu nalaziti unutar uređene plaže.

Novi Pravilnik o brodicama, čamcima i jahtama, koji se primjenjuje od 1. veljače 2020. godine, pojam bajbot, tender ili pomoćna brodica uopće ne obrađuje.

Točnije, spominju se samo u definicijama kao plovila koja pripadaju drugom pomorskom objektu u svrhu prikupljanja, spašavanja ili obavljanja radova, navedeni kao objekti kojima nije obuhvaćen pojam brodica, te u popisu obvezne opreme kao alternativa pneumatskoj splavi za spašavanje, ali bez jasnijih pojašnjenja i ikakvih ograničenja.

Nije se smjelo

U starom Pravilniku ta su ograničenja bila jasno određena člankom 5. Prvim stavkom bilo je definirano kako plovnim objektom koji se ne upisuje u upisnik ili očevidnik, a ima motor snage do 5 kW, mora upravljati osoba koja je osposobljena najmanje kao voditelj brodice kategorije A.

Drugim stavkom takva i ostala plovila koja se ne upisuju u upisnik ili očevidnik (npr. kajak, kanu, gondola, pedalina, daska za jedrenje i dr.) nisu se smjela udaljavati od obale kopna ili otoka više od 500 metara, a trećim se stavkom plovnom objektu duljine do 2,5 metara broj ukrcanih osoba ograničavao na dvije.

U novom Pravilniku ovo je prebačeno u članak 6., međutim, pretpostavljam zbog greške u prepisivanju, prva dva stavka su izostavljena, a ni u Dopunama pravilnika od 29. travnja 2020. nema nikakvih izmjena.

Dakle, prema trenutačno važećem Pravilniku, plovnim objektom duljine do 2,5 m i snage motora do 5 kW, kao i ostalim plovilima koja se ne upisuju u upisnik (kajak, kanu, gondola, pedalina, daska za jedrenje i dr.) može upravljati bilo tko, bez ikakvih ograničenja udaljavanja od obale.

Odnedavno se smije

Nadalje, Pravilnikom o održavanju reda u lukama i na ostalim dijelovima unutarnjih morskih voda i teritorijalnog mora RH u članku 72., gdje se ograničavaju približavanja obali pojedinih vrsta plovila, stavak 4. navodi kako se ovakvi plovni objekti mogu približiti i na udaljenost manju od 50 metara od obale.

Jedino ograničenje navedeno je u članku 76. i odnosi se samo na daske za jedrenje, gdje je jedrenje na dasci, među ostalim, zabranjeno i unutar uređenih plaža.

Dakle, kao odgovor na vaše pitanje mogu reći kako do 1. veljače 2020. plovnim objektom do 2,5 m duljine i snage motora do 5 kW nikako nije moglo upravljati dijete mlađe od 15 godina, kao ni itko tko nema dozvolu voditelja brodice barem kategorije A, niti su se smjeli udaljavati više od 500 metara od obale.

Donošenjem novog Pravilnika o brodicama, čamcima i jahtama, od 1. veljače 2020. godine, tih ograničenja više nema.

Vidio sam u Bolu intenzivan promet bajbota od Zlatnoga rata do usidrenih brodova. Kad nema gužve, to nije strašno, ali kad malo zapuše i plaža je puna ljudi, onda nije ugodno gledati ni kupati se, jer nerijetko gumenjake s pentom voze djeca i vjetar ih kao igračke nosi preko plutača. Za upravljanje im ne treba dozvola, no zanima me je li zakonski uređen taj dio plovidbe od usidrenog broda do plaže? Bi li u takvoj situaciji morali koristiti vesla?

Goran B., Split

Ovim primjerom potaknuli ste više pitanja: kako i koliko se pomoćne brodice mogu udaljiti od matičnoga plovila, tko sve može upravljati malim gumenjacima s motorom snage do 5 kW, te koji se plovni objekti mogu nalaziti unutar uređene plaže.

Novi Pravilnik o brodicama, čamcima i jahtama, koji se primjenjuje od 1. veljače 2020. godine, pojam bajbot, tender ili pomoćna brodica uopće ne obrađuje.

Točnije, spominju se samo u definicijama kao plovila koja pripadaju drugom pomorskom objektu u svrhu prikupljanja, spašavanja ili obavljanja radova, navedeni kao objekti kojima nije obuhvaćen pojam brodica, te u popisu obvezne opreme kao alternativa pneumatskoj splavi za spašavanje, ali bez jasnijih pojašnjenja i ikakvih ograničenja.

Nije se smjelo

U starom Pravilniku ta su ograničenja bila jasno određena člankom 5. Prvim stavkom bilo je definirano kako plovnim objektom koji se ne upisuje u upisnik ili očevidnik, a ima motor snage do 5 kW, mora upravljati osoba koja je osposobljena najmanje kao voditelj brodice kategorije A.

Drugim stavkom takva i ostala plovila koja se ne upisuju u upisnik ili očevidnik (npr. kajak, kanu, gondola, pedalina, daska za jedrenje i dr.) nisu se smjela udaljavati od obale kopna ili otoka više od 500 metara, a trećim se stavkom plovnom objektu duljine do 2,5 metara broj ukrcanih osoba ograničavao na dvije.

U novom Pravilniku ovo je prebačeno u članak 6., međutim, pretpostavljam zbog greške u prepisivanju, prva dva stavka su izostavljena, a ni u Dopunama pravilnika od 29. travnja 2020. nema nikakvih izmjena.

Dakle, prema trenutačno važećem Pravilniku, plovnim objektom duljine do 2,5 m i snage motora do 5 kW, kao i ostalim plovilima koja se ne upisuju u upisnik (kajak, kanu, gondola, pedalina, daska za jedrenje i dr.) može upravljati bilo tko, bez ikakvih ograničenja udaljavanja od obale.

Odnedavno se smije

Nadalje, Pravilnikom o održavanju reda u lukama i na ostalim dijelovima unutarnjih morskih voda i teritorijalnog mora RH u članku 72., gdje se ograničavaju približavanja obali pojedinih vrsta plovila, stavak 4. navodi kako se ovakvi plovni objekti mogu približiti i na udaljenost manju od 50 metara od obale.

Jedino ograničenje navedeno je u članku 76. i odnosi se samo na daske za jedrenje, gdje je jedrenje na dasci, među ostalim, zabranjeno i unutar uređenih plaža.

Dakle, kao odgovor na vaše pitanje mogu reći kako do 1. veljače 2020. plovnim objektom do 2,5 m duljine i snage motora do 5 kW nikako nije moglo upravljati dijete mlađe od 15 godina, kao ni itko tko nema dozvolu voditelja brodice barem kategorije A, niti su se smjeli udaljavati više od 500 metara od obale.

Donošenjem novog Pravilnika o brodicama, čamcima i jahtama, od 1. veljače 2020. godine, tih ograničenja više nema.

Vidio sam u Bolu intenzivan promet bajbota od Zlatnoga rata do usidrenih brodova. Kad nema gužve, to nije strašno, ali kad malo zapuše i plaža je puna ljudi, onda nije ugodno gledati ni kupati se, jer nerijetko gumenjake s pentom voze djeca i vjetar ih kao igračke nosi preko plutača. Za upravljanje im ne treba dozvola, no zanima me je li zakonski uređen taj dio plovidbe od usidrenog broda do plaže? Bi li u takvoj situaciji morali koristiti vesla?

Ovim primjerom potaknuli ste više pitanja: kako i koliko se pomoćne brodice mogu udaljiti od matičnoga plovila, tko sve može upravljati malim gumenjacima s motorom snage do 5 kW, te koji se plovni objekti mogu nalaziti unutar uređene plaže.
