Agent Orange je već godinama predmet mnogobrojnih sudskih procesa. Mnogo puta su vijetnamske žrtve pokušavale optužiti poduzeća koja su uopće omogućila masovnu upotrebu ovog sredstva za otpadanje lišća kod biljaka što je američka vojska koristila kako bi uništila usjeve, ali i šume koje su pružale zaštitu Vietcongu. Prema nekim procjenama, dva do četiri milijuna ljudi pati od posljedica upotrebe ovog sredstva, oko 100.000 je na svijet došlo s najtežim deformacijama i bolestima, analizira Rodion Ebbighausen za Deutsche Welle. 

Nakon što je jedan sud u New Yorku još 2005. upitnim argumentima odbio tužbu nevladine organizacije "Viatnamese Association for Victims of Agent Orange", sudski proces koji je u ponedjeljak okončan u Francuskoj je bio posljednja šansa za pravno rješavanje ovog pitanja. On je bio moguć samo zato što je 2013. u Francuskoj donesen zakon koji francuskim državljanima omogućava podnošenje tužbe protiv stranih tvrtki ako mogu dokazati da su ih ove tvrtke oštetile.

Francuska državljanka Tran To Nga, rođena 1942. u Vijetnamu, je 1966. bila žrtvom jedne akcije zaprašivanja herbicidom Agent Orange. Nakon toga je izgubila jedno dijete, a drugo je na svijet došlo sa zdravstvenim tegobama tipičnim kod zloupotrebe Agent Orangea poput srčanih mana, dijabetesa i astme. Jedan njemački laboratorij je potvrdio da uzrok bolestima treba tražiti u povećanim vrijednostima dioksina u krvi, što je osobina Agent Orangea.

No već od samog početka proizvođači herbicida, poput Monsanta, koji se sada nalazi u vlasništvu njemačkog koncerna Bayer AG, Dow Chemicalsa i nekoliko manjih proizvođača odbacuju svaku odgovornost. I to uvijek istim argumentima. Kao prvo ove tvrtke tvrde da se teške zdravstvene tegobe poput teških tjelesnih deformacija, bolesti živčanog sustava ili dijabetesa, Parkinsona ili raka na mogu direktno povezati s upotrebom Agent Orangea. No isto tako je dokazano da se ove bolesti češće pojavljuju u dijelovima zemlje gdje je ovaj otrov upotrebljavan tako da nedvojbeno postoji povezanost.

Proizvođačima kao i američkoj vladi je od samog početka upotrebe 1961. bilo jasno kakve zdravstvene tegobe sa sobom donosi upotreba ovog sredstva tj. dioksina koje ono sadrži i koji uvelike premašuje u SAD-u dozvoljene vrijednosti. Proizvođači su osim toga, kako bi zadovoljili ogromne narudžbe američke vojske, a time i povećali zaradu, primjenjivali ubrzani proizvodni proces koji rezultira još višim vrijednostima dioksina.

Ženevska konvencija

Kao treće, spomenute kompanije tvrde kako jedino američka vlada može snositi odgovornost jer je jedino ona odredila svrhu i mjesto upotrebe ove kemikalije. No američka vlada nije pred proizvođačima skrivala svoje namjere i upotrebu u južnom Vijetnamu. Dakle znalo se da se ne radi samo o vojnim ciljevima otežavanja kretanja Vitecongu kroz ogoljavanje prašuma nego i ciljano o uništavanju uroda i velikih poljoprivrednih površina gdje je jedina žrtva bila civilno stanovništvo. I toga su proizvođači bili svjesni.

Četvrti argument tuženih se poziva na Ženevsku konvenciju iz 1925. koja doduše brani upotrebu bojnih otrova, ali ne i herbicida. No Ujedinjeni narodi su još 1969. nakon upotrebe Agent Orangea u Vijetnamu zaključili da i herbicidi mogu djelovati kao bojni otrovi te da se time Ženevska konvencija odnosi i na Agent Orange.

Propalo istjerivanje pravde

Unatoč svim ovim argumentima, vijetnamske žrtve nisu 2005. uspjele sa svojom skupnom tužbom protiv kemijskih kompanija. Jedan sud u New Yorku je došao do zaključka da tužene tvrtke ne mogu biti pozvane na odgovornost pozivajući se na već poznate argumente poput nemogućnosti dokazivanja direktne povezanosti, odgovornosti američke vlade te nedostatka uporišta za tužbu u Ženevskoj konvenciji. Ovim posljednjim je ignoriran stav Opće skupštine UN-a.

Pred sudom u francuskom Évryju u ponedjeljak se isprva radilo samo o pitanju nadležnosti ovog suda za ovaj slučaj. I sud je zaključio da nije nadležan. Jer: jedan francuski sud nije odgovoran za djelovanje jedne druge suverene države, u ovom slučaju SAD-a, u ratnim uvjetima. Time je iscrpljena i posljednja mogućnost pravne obrade tragedije vezane uz upotrebu Agent Orangea. Pritom stanovništvo pogođenih područja i dan danas pati od posljedica jer dioksin ostaje desetljećima u tlu, taloži se u organizmima i utječe na promjenu gena kod ljudi.

Agent Orange je već godinama predmet mnogobrojnih sudskih procesa. Mnogo puta su vijetnamske žrtve pokušavale optužiti poduzeća koja su uopće omogućila masovnu upotrebu ovog sredstva za otpadanje lišća kod biljaka što je američka vojska koristila kako bi uništila usjeve, ali i šume koje su pružale zaštitu Vietcongu. Prema nekim procjenama, dva do četiri milijuna ljudi pati od posljedica upotrebe ovog sredstva, oko 100.000 je na svijet došlo s najtežim deformacijama i bolestima, analizira Rodion Ebbighausen za Deutsche Welle. 

Nakon što je jedan sud u New Yorku još 2005. upitnim argumentima odbio tužbu nevladine organizacije "Viatnamese Association for Victims of Agent Orange", sudski proces koji je u ponedjeljak okončan u Francuskoj je bio posljednja šansa za pravno rješavanje ovog pitanja. On je bio moguć samo zato što je 2013. u Francuskoj donesen zakon koji francuskim državljanima omogućava podnošenje tužbe protiv stranih tvrtki ako mogu dokazati da su ih ove tvrtke oštetile.

Francuska državljanka Tran To Nga, rođena 1942. u Vijetnamu, je 1966. bila žrtvom jedne akcije zaprašivanja herbicidom Agent Orange. Nakon toga je izgubila jedno dijete, a drugo je na svijet došlo sa zdravstvenim tegobama tipičnim kod zloupotrebe Agent Orangea poput srčanih mana, dijabetesa i astme. Jedan njemački laboratorij je potvrdio da uzrok bolestima treba tražiti u povećanim vrijednostima dioksina u krvi, što je osobina Agent Orangea.

No već od samog početka proizvođači herbicida, poput Monsanta, koji se sada nalazi u vlasništvu njemačkog koncerna Bayer AG, Dow Chemicalsa i nekoliko manjih proizvođača odbacuju svaku odgovornost. I to uvijek istim argumentima. Kao prvo ove tvrtke tvrde da se teške zdravstvene tegobe poput teških tjelesnih deformacija, bolesti živčanog sustava ili dijabetesa, Parkinsona ili raka na mogu direktno povezati s upotrebom Agent Orangea. No isto tako je dokazano da se ove bolesti češće pojavljuju u dijelovima zemlje gdje je ovaj otrov upotrebljavan tako da nedvojbeno postoji povezanost.

Proizvođačima kao i američkoj vladi je od samog početka upotrebe 1961. bilo jasno kakve zdravstvene tegobe sa sobom donosi upotreba ovog sredstva tj. dioksina koje ono sadrži i koji uvelike premašuje u SAD-u dozvoljene vrijednosti. Proizvođači su osim toga, kako bi zadovoljili ogromne narudžbe američke vojske, a time i povećali zaradu, primjenjivali ubrzani proizvodni proces koji rezultira još višim vrijednostima dioksina.

Ženevska konvencija

Kao treće, spomenute kompanije tvrde kako jedino američka vlada može snositi odgovornost jer je jedino ona odredila svrhu i mjesto upotrebe ove kemikalije. No američka vlada nije pred proizvođačima skrivala svoje namjere i upotrebu u južnom Vijetnamu. Dakle znalo se da se ne radi samo o vojnim ciljevima otežavanja kretanja Vitecongu kroz ogoljavanje prašuma nego i ciljano o uništavanju uroda i velikih poljoprivrednih površina gdje je jedina žrtva bila civilno stanovništvo. I toga su proizvođači bili svjesni.

Četvrti argument tuženih se poziva na Ženevsku konvenciju iz 1925. koja doduše brani upotrebu bojnih otrova, ali ne i herbicida. No Ujedinjeni narodi su još 1969. nakon upotrebe Agent Orangea u Vijetnamu zaključili da i herbicidi mogu djelovati kao bojni otrovi te da se time Ženevska konvencija odnosi i na Agent Orange.

Propalo istjerivanje pravde

Unatoč svim ovim argumentima, vijetnamske žrtve nisu 2005. uspjele sa svojom skupnom tužbom protiv kemijskih kompanija. Jedan sud u New Yorku je došao do zaključka da tužene tvrtke ne mogu biti pozvane na odgovornost pozivajući se na već poznate argumente poput nemogućnosti dokazivanja direktne povezanosti, odgovornosti američke vlade te nedostatka uporišta za tužbu u Ženevskoj konvenciji. Ovim posljednjim je ignoriran stav Opće skupštine UN-a.

Pred sudom u francuskom Évryju u ponedjeljak se isprva radilo samo o pitanju nadležnosti ovog suda za ovaj slučaj. I sud je zaključio da nije nadležan. Jer: jedan francuski sud nije odgovoran za djelovanje jedne druge suverene države, u ovom slučaju SAD-a, u ratnim uvjetima. Time je iscrpljena i posljednja mogućnost pravne obrade tragedije vezane uz upotrebu Agent Orangea. Pritom stanovništvo pogođenih područja i dan danas pati od posljedica jer dioksin ostaje desetljećima u tlu, taloži se u organizmima i utječe na promjenu gena kod ljudi.

Agent Orange je već godinama predmet mnogobrojnih sudskih procesa. Mnogo puta su vijetnamske žrtve pokušavale optužiti poduzeća koja su uopće omogućila masovnu upotrebu ovog sredstva za otpadanje lišća kod biljaka što je američka vojska koristila kako bi uništila usjeve, ali i šume koje su pružale zaštitu Vietcongu. Prema nekim procjenama, dva do četiri milijuna ljudi pati od posljedica upotrebe ovog sredstva, oko 100.000 je na svijet došlo s najtežim deformacijama i bolestima, analizira Rodion Ebbighausen za Deutsche Welle.
