Od ovog ponedjeljka, kada je Državno izborno povjerenstvo objavilo konačne rezultate izbora, počeo je teći rok od dvadeset dana za sazivanje konstituirajuće sjednice Sabora.

Zastupnike na prvo zasjedanje saziva predsjednik Republike, no pitanje je hoće li se na toj sjednici Sabor i konstituirati, što bi značilo da je izabran predsjednik. Ako predsjednik Sabora ne bude izabran, bit će sazvana sljedeća sjednica kad postane jasno postoji li neka većina.

Naime, do sada se od deset saziva Sabor samo jednom nije konstituirao. Bilo je to u prosincu 2015. godine, kada je sazvan osmi saziv i tada nije izabran novi predsjednik, što je zastupnicima uspjelo tek iz drugog pokušaja, za nepunih mjesec dana. Za predsjednika je bio izabran Željko Reiner iz HDZ-a s 88 glasova za, 62 suzdržana i jednim protiv. Tek od toga trenutka počeo je teći mandat novim zastupnicima, koji su potom iduće godine u srpnju, na prijedlog 89 zastupnika, odlučili da se Sabor raspusti.

Dosta je i 39 glasova

Dakle, u idućih dvadeset dana Zoran Milanović mora sazvati prvu saborsku sjednicu, a na njoj može i ne mora biti izabran predsjednik.

Predsjednik Sabora, međutim, može biti izabran i običnom većinom zastupnika, što znači teoretski s 39 glasova ako ima kvoruma. Saborski klubovi u tom slučaju mogu početi raspravljati, usvajati zakone i akte i o njima glasati. Paralelno se može odvijati proces sastavljanja većine i prvi koji ima 76 ruku ide k predsjedniku Republike po mandat za sastavljanje Vlade.

Mandatar, naime, mora biti netko tko ima 76 potpisa neovisno o tome je li Sabor konstituiran, a zatim od predsjednika dobiva rok od trideset dana da sastavi Vladu. Ako mandatar ne sastavi Vladu u roku od 30 dana od dana prihvaćanja mandata, predsjednik Republike može mu produljiti mandat za najviše još 30 dana.

Ako ni u tom roku mandatar ne uspije sastaviti Vladu ili ako predložena Vlada ne dobije povjerenje Hrvatskoga sabora, predsjednik Republike povjerit će mandat za sastav Vlade drugoj osobi i tada počinje za njega teći rok od novih 30 plus 30 dana.

Ako svi pokušaji za sastavljanje Vlade propadnu, članak 109.b Ustava navodi da će predsjednik Republike imenovati privremenu nestranačku Vladu i istodobno raspisati prijevremene izbore za Hrvatski sabor. Odluku o ponovljenim izborima mogu izglasati i saborski zastupnici ako njih 76 za to digne ruku i tada predsjednik države također mora u idućih 60 dana raspisati nove izbore.

Ustav, međutim, nije propisao koliko dugo se čeka onoga tko predsjedniku Republike donosi većinu potpisa. Naime, ako nema mandatara i većine, nema ni roka. Čak ni potpisi nisu zakonski propisani, ali su dobar običaj i iskaz povjerenja koji je do sada funkcionirao pa nema razloga misliti da bi ovaj put bilo suprotno, tvrde pravni stručnjaci.

Prvi put su doneseni tadašnjem predsjedniku države Stjepanu Mesiću, kada je Dražen Budiša iz HSLS-a izišao iz koalicije s Račanovim SDP-om. Ti potpisi su bili jamstvo da Ivica Račan ima natpolovičnu većinu za sastavljanje Vlade i od tada se ustalila ta praksa.

Predsjednik svakako mora dati mandat onome tko ima većinu. U varijanti, a i ta je moguća, da se takav ne pojavi, predsjednik bi, u skladu s demokratskim načelima, morao ponuditi mandat relativnom pobjedniku izbora.

Rok za sastavljanje Vlade nije definiran s obzirom da je Ustav pisan za vrijeme prelaska iz polupredsjedničkog u parlamentarni sustav, pa je tu, ocjenjuju neki pravni stručnjaci, ostala svojevrsna praznina.

Zoran Milanović je u kampanji rekao da neće požurivati nikoga da donese potpise većine, kao što je to, kako je kazao, radila njegova prethodnica Kolinda Grabar-Kitarović. Ona je, naime, nakon izbora 2015. godine požurivala formiranje Vlade prijetivši raspisivanjem novih izbora i navodno već imala spremnu svoju nestranačku Vladu, koja bi u međuvremenu preuzela vođenje zemlje.

Tada su se, podsjetimo, pregovori Mosta sa SDP-om i HDZ-om oduljili pa je predsjednica planirala privremenu Vladu RH kojoj je na čelu trebao biti Damir Vanđelić. Kako je ipak sklopljen novi dogovor, i to između Mosta i HDZ-a, takav plan predsjednice je propao.

Mogućnost za nestranačku Vladu, propadnu li sada pregovori HDZ-a kao relativnog izbornog pobjednika s Domovinskim pokretom, nalazi se i pred predsjednikom Zoranom Milanovićem. Formiranjem takve Vlade prestao bi mandat sadašnje tehničke Vlade na čelu s Andrejem Plenkovićem.

Matematika zasad govori da su drugi tjedan nakon održavanja izbora i dalje moguće sve kombinacije u zakonskim okvirima, ali konstituiranje Sabora svakako ubrzava sve procese.

Od ovog ponedjeljka, kada je Državno izborno povjerenstvo objavilo konačne rezultate izbora, počeo je teći rok od dvadeset dana za sazivanje konstituirajuće sjednice Sabora.

Zastupnike na prvo zasjedanje saziva predsjednik Republike, no pitanje je hoće li se na toj sjednici Sabor i konstituirati, što bi značilo da je izabran predsjednik. Ako predsjednik Sabora ne bude izabran, bit će sazvana sljedeća sjednica kad postane jasno postoji li neka većina.

Naime, do sada se od deset saziva Sabor samo jednom nije konstituirao. Bilo je to u prosincu 2015. godine, kada je sazvan osmi saziv i tada nije izabran novi predsjednik, što je zastupnicima uspjelo tek iz drugog pokušaja, za nepunih mjesec dana. Za predsjednika je bio izabran Željko Reiner iz HDZ-a s 88 glasova za, 62 suzdržana i jednim protiv. Tek od toga trenutka počeo je teći mandat novim zastupnicima, koji su potom iduće godine u srpnju, na prijedlog 89 zastupnika, odlučili da se Sabor raspusti.

Dosta je i 39 glasova

Dakle, u idućih dvadeset dana Zoran Milanović mora sazvati prvu saborsku sjednicu, a na njoj može i ne mora biti izabran predsjednik.

Predsjednik Sabora, međutim, može biti izabran i običnom većinom zastupnika, što znači teoretski s 39 glasova ako ima kvoruma. Saborski klubovi u tom slučaju mogu početi raspravljati, usvajati zakone i akte i o njima glasati. Paralelno se može odvijati proces sastavljanja većine i prvi koji ima 76 ruku ide k predsjedniku Republike po mandat za sastavljanje Vlade.

Mandatar, naime, mora biti netko tko ima 76 potpisa neovisno o tome je li Sabor konstituiran, a zatim od predsjednika dobiva rok od trideset dana da sastavi Vladu. Ako mandatar ne sastavi Vladu u roku od 30 dana od dana prihvaćanja mandata, predsjednik Republike može mu produljiti mandat za najviše još 30 dana.

Ako ni u tom roku mandatar ne uspije sastaviti Vladu ili ako predložena Vlada ne dobije povjerenje Hrvatskoga sabora, predsjednik Republike povjerit će mandat za sastav Vlade drugoj osobi i tada počinje za njega teći rok od novih 30 plus 30 dana.

Ako svi pokušaji za sastavljanje Vlade propadnu, članak 109.b Ustava navodi da će predsjednik Republike imenovati privremenu nestranačku Vladu i istodobno raspisati prijevremene izbore za Hrvatski sabor. Odluku o ponovljenim izborima mogu izglasati i saborski zastupnici ako njih 76 za to digne ruku i tada predsjednik države također mora u idućih 60 dana raspisati nove izbore.

Ustav, međutim, nije propisao koliko dugo se čeka onoga tko predsjedniku Republike donosi većinu potpisa. Naime, ako nema mandatara i većine, nema ni roka. Čak ni potpisi nisu zakonski propisani, ali su dobar običaj i iskaz povjerenja koji je do sada funkcionirao pa nema razloga misliti da bi ovaj put bilo suprotno, tvrde pravni stručnjaci.

Prvi put su doneseni tadašnjem predsjedniku države Stjepanu Mesiću, kada je Dražen Budiša iz HSLS-a izišao iz koalicije s Račanovim SDP-om. Ti potpisi su bili jamstvo da Ivica Račan ima natpolovičnu većinu za sastavljanje Vlade i od tada se ustalila ta praksa.

Propao Kolindin plan

Predsjednik svakako mora dati mandat onome tko ima većinu. U varijanti, a i ta je moguća, da se takav ne pojavi, predsjednik bi, u skladu s demokratskim načelima, morao ponuditi mandat relativnom pobjedniku izbora.

Rok za sastavljanje Vlade nije definiran s obzirom da je Ustav pisan za vrijeme prelaska iz polupredsjedničkog u parlamentarni sustav, pa je tu, ocjenjuju neki pravni stručnjaci, ostala svojevrsna praznina.

Zoran Milanović je u kampanji rekao da neće požurivati nikoga da donese potpise većine, kao što je to, kako je kazao, radila njegova prethodnica Kolinda Grabar-Kitarović. Ona je, naime, nakon izbora 2015. godine požurivala formiranje Vlade prijetivši raspisivanjem novih izbora i navodno već imala spremnu svoju nestranačku Vladu, koja bi u međuvremenu preuzela vođenje zemlje.

Tada su se, podsjetimo, pregovori Mosta sa SDP-om i HDZ-om oduljili pa je predsjednica planirala privremenu Vladu RH kojoj je na čelu trebao biti Damir Vanđelić. Kako je ipak sklopljen novi dogovor, i to između Mosta i HDZ-a, takav plan predsjednice je propao.

Mogućnost za nestranačku Vladu, propadnu li sada pregovori HDZ-a kao relativnog izbornog pobjednika s Domovinskim pokretom, nalazi se i pred predsjednikom Zoranom Milanovićem. Formiranjem takve Vlade prestao bi mandat sadašnje tehničke Vlade na čelu s Andrejem Plenkovićem.

Matematika zasad govori da su drugi tjedan nakon održavanja izbora i dalje moguće sve kombinacije u zakonskim okvirima, ali konstituiranje Sabora svakako ubrzava sve procese.
