Suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice. To može učiniti većina, odnosno oni koji zajednički imaju većinu suvlasničkih dijelova, piše Zgradonačelnik.
Svaki od suvlasnika nekretnine, koja se sastoji od zemljišta sa zgradom ili od prava građenja sa zgradom, dužan je prigodom izvršavanja svoga prava postupati osobito obzirno prema ostalima.
U protivnom, suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice, pod pretpostavkama koje određuju članci 98. i 99. Zakona o vlasništvu i drugim stvarnim pravima.
Isključenje iz suvlasničke zajednice, kao institut propisan odredbama Zakona o vlasništvu i drugim stvarnim pravima, predviđeno je samo za krajnje slučajeve kad drugi vlasnici stanova više, uvjetno rečeno, nemaju drugog izlaza iz nepodnošljive situacije zajedničkog stanovanja s vlasnikom (korisnikom) nekretnine, osim da posegnu za isključenjem tog suvlasnika iz suvlasničke zajednice.
Primjerice, može se dogoditi da neki suvlasnik u zgradi godinama ne plaća zajedničku pričuvu i općenito svojim ponašanjem i pasivnošću ne doprinosi, odnosno odmaže uspješnom održavanju zgrade.
Tko traži isključenje?
Svaki od suvlasnika iste nekretnine, koji se sastoji od zemljišta sa zgradom, dužan je prilikom izvršavanja svoga prava postupati obzirno prema ostalima. U protivnom, ostali suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice. To može učiniti većina, odnosno oni koji zajednički imaju većinu suvlasničkih dijelova ili, pak, manjina.
Isključenje na zahtjev većine moguće je ako:
- suvlasnik ne udovoljava dužnostima koje proistječu iz zajednice, osobito ako ne plati dužne iznose ni do završetka rasprave koja prethodi presudi prvostupanjskog suda, a ako je sporno koji je iznos bio dužan platiti, sud donosi međupresudu
- dijelove nekretnine koji su u njegovom vlasništvu kao posebni dijelovi ili dijelove koje koriste i drugi suvlasnici koristi na način koji ide znatno na štetu drugih suvlasnika
- svojim bezobzirnim, nepristojnim ili uopće nedoličnim ponašanjem zajedničko stanovanje ostalim suvlasnicima učini tegobnim ili počini kazneno djelo protiv imovine, morala ili tjelesne cjelovitosti bilo kojeg od suvlasnika ili druge osobe koja stanuje u kući, a nije riječ o djelima tako malog značaja da bi ih trebalo zanemariti. Radnje i ponašanje suvlasnikova bračnog druga i drugih članova obitelji koji s njim/njom stanuju, kao i osoba koje uz njegov pristanak koriste dijelove nekretnine, a koje je on mogao spriječiti, uzimaju se za radnje tog suvlasnika
Suvlasnici koji su odlučili da će zahtijevati isključenje određenog suvlasnika, tužbom će zahtijevati da sud utvrdi postojanje razloga za isključenje i odluči da je tuženik dužan otuđiti svoj suvlasnički dio i napustiti posjed ili će se na zahtjev tužitelja koji ne može biti sastavljen u roku kraćem od tri mjeseca od pravomoćne presude tuženikov suvlasnički dio prodati na javnoj dražbi. Time što suvlasnički dio stekne treća osoba, zajednica s isključenim suvlasnikom prestaje.
Isključenje na zahtjev manjine moguće je ako:
- je neki suvlasnik bezobzirnim, nepristojnim ili uopće nedoličnim ponašanjem povrijedio drugog suvlasnika, koji ga nije ničim izazvao, učinio mu tegobnim zajedničko stanovanje ili je počinio kažnjivo djelo protiv njegove imovine, morala ili tjelesne cjelovitosti, ili nekog od njegovih ukućana, a nije riječ o djelima tako malog značaja da bi trebalo zanemariti. Također i ponašanje suvlasnikova bračnog druga i drugih članova obitelji koji s njim stanuju, kao i osoba koje s njegovim pristankom koriste dijelove nekretnine, a koje je on mogao spriječiti, uzimaju se kao radnje tog suvlasnika.
- Povrijeđeni suvlasnik, ako i nije dobio od drugih dovoljnu potporu da bi većina donijela odluku o isključenju, može sam tužbom zahtijevati od ovoga da se ubuduće suzdržava od takvih postupaka. No, nastave li se oni i nakon pravomoćne presude, povrijeđeni sam može podnijeti tužbu kojom se tuženiku nalaže da je dužan otuđiti svoj suvlasnički dio i napustiti posjed te se u tom slučaju na odgovarajući način primjenjuju odredbe koje inače vrijede kad tužbu podnose suvlasnici koji imaju većinu suvlasničkih udjela.

Suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice. To može učiniti većina, odnosno oni koji zajednički imaju većinu suvlasničkih dijelova, piše Zgradonačelnik.
Svaki od suvlasnika nekretnine, koja se sastoji od zemljišta sa zgradom ili od prava građenja sa zgradom, dužan je prigodom izvršavanja svoga prava postupati osobito obzirno prema ostalima.
U protivnom, suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice, pod pretpostavkama koje određuju članci 98. i 99. Zakona o vlasništvu i drugim stvarnim pravima.
Isključenje iz suvlasničke zajednice, kao institut propisan odredbama Zakona o vlasništvu i drugim stvarnim pravima, predviđeno je samo za krajnje slučajeve kad drugi vlasnici stanova više, uvjetno rečeno, nemaju drugog izlaza iz nepodnošljive situacije zajedničkog stanovanja s vlasnikom (korisnikom) nekretnine, osim da posegnu za isključenjem tog suvlasnika iz suvlasničke zajednice.
Primjerice, može se dogoditi da neki suvlasnik u zgradi godinama ne plaća zajedničku pričuvu i općenito svojim ponašanjem i pasivnošću ne doprinosi, odnosno odmaže uspješnom održavanju zgrade.
Tko traži isključenje?
Svaki od suvlasnika iste nekretnine, koji se sastoji od zemljišta sa zgradom, dužan je prilikom izvršavanja svoga prava postupati obzirno prema ostalima. U protivnom, ostali suvlasnici mogu ishoditi njegovo isključenje iz suvlasničke zajednice. To može učiniti većina, odnosno oni koji zajednički imaju većinu suvlasničkih dijelova ili, pak, manjina.
Isključenje na zahtjev većine moguće je ako:
- suvlasnik ne udovoljava dužnostima koje proistječu iz zajednice, osobito ako ne plati dužne iznose ni do završetka rasprave koja prethodi presudi prvostupanjskog suda, a ako je sporno koji je iznos bio dužan platiti, sud donosi međupresudu
- dijelove nekretnine koji su u njegovom vlasništvu kao posebni dijelovi ili dijelove koje koriste i drugi suvlasnici koristi na način koji ide znatno na štetu drugih suvlasnika
- svojim bezobzirnim, nepristojnim ili uopće nedoličnim ponašanjem zajedničko stanovanje ostalim suvlasnicima učini tegobnim ili počini kazneno djelo protiv imovine, morala ili tjelesne cjelovitosti bilo kojeg od suvlasnika ili druge osobe koja stanuje u kući, a nije riječ o djelima tako malog značaja da bi ih trebalo zanemariti. Radnje i ponašanje suvlasnikova bračnog druga i drugih članova obitelji koji s njim/njom stanuju, kao i osoba koje uz njegov pristanak koriste dijelove nekretnine, a koje je on mogao spriječiti, uzimaju se za radnje tog suvlasnika
Suvlasnici koji su odlučili da će zahtijevati isključenje određenog suvlasnika, tužbom će zahtijevati da sud utvrdi postojanje razloga za isključenje i odluči da je tuženik dužan otuđiti svoj suvlasnički dio i napustiti posjed ili će se na zahtjev tužitelja koji ne može biti sastavljen u roku kraćem od tri mjeseca od pravomoćne presude tuženikov suvlasnički dio prodati na javnoj dražbi. Time što suvlasnički dio stekne treća osoba, zajednica s isključenim suvlasnikom prestaje.
Isključenje na zahtjev manjine moguće je ako:
- je neki suvlasnik bezobzirnim, nepristojnim ili uopće nedoličnim ponašanjem povrijedio drugog suvlasnika, koji ga nije ničim izazvao, učinio mu tegobnim zajedničko stanovanje ili je počinio kažnjivo djelo protiv njegove imovine, morala ili tjelesne cjelovitosti, ili nekog od njegovih ukućana, a nije riječ o djelima tako malog značaja da bi trebalo zanemariti. Također i ponašanje suvlasnikova bračnog druga i drugih članova obitelji koji s njim stanuju, kao i osoba koje s njegovim pristankom koriste dijelove nekretnine, a koje je on mogao spriječiti, uzimaju se kao radnje tog suvlasnika.
- Povrijeđeni suvlasnik, ako i nije dobio od drugih dovoljnu potporu da bi većina donijela odluku o isključenju, može sam tužbom zahtijevati od ovoga da se ubuduće suzdržava od takvih postupaka. No, nastave li se oni i nakon pravomoćne presude, povrijeđeni sam može podnijeti tužbu kojom se tuženiku nalaže da je dužan otuđiti svoj suvlasnički dio i napustiti posjed te se u tom slučaju na odgovarajući način primjenjuju odredbe koje inače vrijede kad tužbu podnose suvlasnici koji imaju većinu suvlasničkih udjela.
