Teško je ljudima izvan pravne branše u potpunosti razumjeti jezik kojim barataju. Upravo zbog toga zamolili smo Nataliju Mladineo, stečajnu upraviteljicu tvrtke “Sportski grad TPN”, da nam odgovori na par pitanja.
Zanimalo nas je što bi još trebalo prethoditi stavljanju nekretnine na tržište.
– Osnovni je cilj svakog stečajnog postupka prodaja imovine stečajnog dužnika u svrhu namirenja obveza prema vjerovnicima – objasnila nam je upraviteljica osnove postupka.

Stečajni postupak nad “Sportskim gradom TPN” traje od listopada 2014. i tijekom tog razdoblja stečajni dužnik obavljao je djelatnost i iz ostvarenih prihoda namirivao tekuće troškove poslovanja, plaće zaposlenika i ulagao u tekuće održavanje tehničke opreme i građevine Spaladium Arene.
Ovrhom koju je pokrenuo Grad Split, a koja je rezultirala blokadom žiroračuna stečajnog dužnika, taj je ciklus prekinut. Unatoč podnescima odgovornim osobama u Gradu Splitu i legalnim pravnim mogućnostima da se s Gradom Splitom sklopi nagodba o odgodi ovrhe i plaćanja duga kad se imovina unovči, Grad se u tom smjeru nije očitovao.
Opet se naglašava da nije bilo zakonskih prepreka za sklapanje nagodbe koja bi Grad Split zaštitila od bilo kakvog pogodovanja stečajnom dužniku jer bi svoja potraživanja naplatio nakon okončanja stečajnog postupka, što bi stečajnom dužniku omogućilo nastavak rada i zaštitu objekta i tehničke opreme – kazala nam je Mladineo.

– Međutim, Grad Split, unatoč činjenici da je vlasnik prava građenja na zemljištu na kojem je sagrađena Spaladium Arena, da mu se objekt vraća nakon što protekne 15 godina te da je u ovom stečajnom postupku i stečajni vjerovnik i vjerovnik stečajne mase, nije pokazao interes za objekt vrijedan 66.360.000 eura. Takav stav izložio je Spaladium Arenu devastaciji – jasna je stečajna upraviteljica.
– Zbog svega navedenog, kao i zbog činjenice da su stečajna upraviteljica i sud dužni zaštititi imovinu stečajnog dužnika od devastacije i propadanja, kao jedina zakonska i logična odluka donesena je odluka o prodaji.

S obzirom na to da je u zemljišnim knjigama na nekretnini Spaladium Arene upisano založno pravo u korist Erste banke, Bank Austrije i ZABA-e, imovina će se prodavati provođenjem elektroničke javne dražbe pred FINA-om.
Stavljanju nekretnine na dražbu prethodit će zakazivanje ročišta na kojem će se razlučni vjerovnici očitovati o vrijednosti nekretnine po kojoj će ona biti izložena prodaji – kazala nam je Natalija Mladineo.

Teško je ljudima izvan pravne branše u potpunosti razumjeti jezik kojim barataju. Upravo zbog toga zamolili smo Nataliju Mladineo, stečajnu upraviteljicu tvrtke “Sportski grad TPN”, da nam odgovori na par pitanja.
Zanimalo nas je što bi još trebalo prethoditi stavljanju nekretnine na tržište.
– Osnovni je cilj svakog stečajnog postupka prodaja imovine stečajnog dužnika u svrhu namirenja obveza prema vjerovnicima – objasnila nam je upraviteljica osnove postupka.

Stečajni postupak nad “Sportskim gradom TPN” traje od listopada 2014. i tijekom tog razdoblja stečajni dužnik obavljao je djelatnost i iz ostvarenih prihoda namirivao tekuće troškove poslovanja, plaće zaposlenika i ulagao u tekuće održavanje tehničke opreme i građevine Spaladium Arene.
Ovrhom koju je pokrenuo Grad Split, a koja je rezultirala blokadom žiroračuna stečajnog dužnika, taj je ciklus prekinut. Unatoč podnescima odgovornim osobama u Gradu Splitu i legalnim pravnim mogućnostima da se s Gradom Splitom sklopi nagodba o odgodi ovrhe i plaćanja duga kad se imovina unovči, Grad se u tom smjeru nije očitovao.
Opet se naglašava da nije bilo zakonskih prepreka za sklapanje nagodbe koja bi Grad Split zaštitila od bilo kakvog pogodovanja stečajnom dužniku jer bi svoja potraživanja naplatio nakon okončanja stečajnog postupka, što bi stečajnom dužniku omogućilo nastavak rada i zaštitu objekta i tehničke opreme – kazala nam je Mladineo.

– Međutim, Grad Split, unatoč činjenici da je vlasnik prava građenja na zemljištu na kojem je sagrađena Spaladium Arena, da mu se objekt vraća nakon što protekne 15 godina te da je u ovom stečajnom postupku i stečajni vjerovnik i vjerovnik stečajne mase, nije pokazao interes za objekt vrijedan 66.360.000 eura. Takav stav izložio je Spaladium Arenu devastaciji – jasna je stečajna upraviteljica.
– Zbog svega navedenog, kao i zbog činjenice da su stečajna upraviteljica i sud dužni zaštititi imovinu stečajnog dužnika od devastacije i propadanja, kao jedina zakonska i logična odluka donesena je odluka o prodaji.

S obzirom na to da je u zemljišnim knjigama na nekretnini Spaladium Arene upisano založno pravo u korist Erste banke, Bank Austrije i ZABA-e, imovina će se prodavati provođenjem elektroničke javne dražbe pred FINA-om.
Stavljanju nekretnine na dražbu prethodit će zakazivanje ročišta na kojem će se razlučni vjerovnici očitovati o vrijednosti nekretnine po kojoj će ona biti izložena prodaji – kazala nam je Natalija Mladineo.
