Ingrid Pečarević, stručna voditeljica Park šume Marjan, oslobođena je na splitskom Općinskom prekršajnom sudu optužbe da je remetila javni red i mir, piše Dalmatinski portal. Optužni prijedlog podigla je policija, i to nakon što im se u postaju u pratnji kolega 12. travnja prošle godine ušetala edukatorica ustanove Marijana Balić Carevski i potom prijavila Pečarević da je na sastanku u 8 sati u hodniku na nju vikala i vrijeđala je sljedećim riječima: ‘Nesposobna si, došla si preko veze na posao.  Nemaš što raditi pet dana u tjednu u tvrtki. Što se mene tiče, možeš ići kući, ja ću se osobno pobrinuti da više ne radiš ovdje‘.

Sve je to kod Balić Carevski izazvalo intenzivan stres uslijed čega joj je pozlilo te joj je pružena liječnička pomoć, a navedeno je ponašanje izazvalo i uznemirenost ostalih nazočnih djelatnika, stoji u optužnom prijedlogu. Sve se odigralo tek mjesec dana nakon što je policija došla po Balić Carevski u ustanovu radi prijave dogradonačelnika Bojana Ivoševića za neovlašteno snimanje. 

Pečarević je negirala da je remetila red i mir i vikala na kolegicu. Na kolegiju ujutro joj je kazala da nema zapreke da radi u Visitor centru kako ne bi za to plaćali studente, na što joj je Balić Carevski odgovorila kako ona nema vremena za to. Pečarević joj je rekla da će o tome odlučiti ravnatelj. Prisjetila se kako je potom Balić Carevski izašla vani, da je nešto razgovarala na telefon, a potom je ušla u sobu koju dijele i počela plakati. Ona joj je prišla, mislila je da ima nekih privatnih problema, no Balić Carevski je izašla. U sobu je potom ušao bivši ravnatelj Robert Koharević i kazao joj da će kolegicu prebaciti na Prvu pomoć. Popodne joj je na vrata zakucala policija.

Balić Carevski je kazala da je odnos s Pečarević bio narušen od ranije i da joj je na početku kolegija počela postavljati pitanja vezana za posao, i to odmah povišenim tonom koji je prerastao u viku. Pokušala je odgovoriti, ali ju je Pečarević stalno prekidala. Optužila ju je da laže i da nema što raditi osam sati u danu. Odgovorila je da piše novi priručnik, a ona joj je kazala da je to posao od pola sata. To joj je zazvučalo ponižavajuće i uvredljivo, pozlilo joj je, a onda je čula Pečarević da tadašnjem ravnatelju Stipi Mušuri govori kako će se ona za ovo pobrinuti. Otišla je u ured i nazvala liječnicu, ali je nije uspjela dobiti. Osjećala se sve lošije pa su je prebacili na Hitnu...  

Sud nije prihvatio iskaz oštećenice držeći ga subjektivnim budući da je prvenstveno odraz narušenog odnosa između nje i okrivljenice u dužem vremenskom periodu.  

Sud smatra nesporno utvrđenim da je bilo povišenih tonova, ali sud nije našao dokazanim da bi time bila uznemirena javnost, odnosno, djelatnici ustanove pa nije našao ni dokazanim da su se ostvarila obilježja prekršaja iz članka 13. stavka 1. Zakona o prekršajima protiv javnog reda i mira‘, stoji u presudi.

Branitelj Denis Kulušić zadovoljan je oslobađajućom presudom.

‘Nedvojbeno je utvrđeno da nije došlo do remećenja javnog reda i mira, već se radilo o uobičajenoj komunikaciji unutar javne ustanove. Nije došlo do uznemirenja javnosti, a ni djelatnika ustanove, što su potvrdili gotovo svi saslušani svjedoci pa je bilo za očekivati ovakvu odluku suda‘, kazao je za Dalmatinski portal odvjetnik Kulušić.

Ivošević: Neka, neka

Zamjenik splitskog gradonačelnika Bojan Ivošević jako je zadovoljan zbog ove presude, sudeći po njegovoj Facebook objavi:

- Čisto da vidite s čime se sve susrećemo u obavljanju našeg posla.

Mogu samo iskazati zadovoljstvo zbog ove presude gdje je sud jasno dao do znanja da rukovodeći ljudi imaju pravo uputiti kritiku na (ne)rad nezakonito zaposlenih osoba, te da lažne prijave dotičnih neće prolaziti, već da se trebaju uhvatiti posla.

JU PŠ Marjan nastavit će racionalizirati i unaprijeđivati svoj rad, a jedan od prvih idućih koraka je nova sistematizacija koja je u petak zaprimljena u gradsku upravu gdje je sad očekuje zakonska procedura koju mora proći prije nego stupi na snagu.

Ingrid Pečarević, stručna voditeljica Park šume Marjan, oslobođena je na splitskom Općinskom prekršajnom sudu optužbe da je remetila javni red i mir, piše Dalmatinski portal. Optužni prijedlog podigla je policija, i to nakon što im se u postaju u pratnji kolega 12. travnja prošle godine ušetala edukatorica ustanove Marijana Balić Carevski i potom prijavila Pečarević da je na sastanku u 8 sati u hodniku na nju vikala i vrijeđala je sljedećim riječima: ‘Nesposobna si, došla si preko veze na posao.  Nemaš što raditi pet dana u tjednu u tvrtki. Što se mene tiče, možeš ići kući, ja ću se osobno pobrinuti da više ne radiš ovdje‘.

Sve je to kod Balić Carevski izazvalo intenzivan stres uslijed čega joj je pozlilo te joj je pružena liječnička pomoć, a navedeno je ponašanje izazvalo i uznemirenost ostalih nazočnih djelatnika, stoji u optužnom prijedlogu. Sve se odigralo tek mjesec dana nakon što je policija došla po Balić Carevski u ustanovu radi prijave dogradonačelnika Bojana Ivoševića za neovlašteno snimanje. 

Pečarević je negirala da je remetila red i mir i vikala na kolegicu. Na kolegiju ujutro joj je kazala da nema zapreke da radi u Visitor centru kako ne bi za to plaćali studente, na što joj je Balić Carevski odgovorila kako ona nema vremena za to. Pečarević joj je rekla da će o tome odlučiti ravnatelj. Prisjetila se kako je potom Balić Carevski izašla vani, da je nešto razgovarala na telefon, a potom je ušla u sobu koju dijele i počela plakati. Ona joj je prišla, mislila je da ima nekih privatnih problema, no Balić Carevski je izašla. U sobu je potom ušao bivši ravnatelj Robert Koharević i kazao joj da će kolegicu prebaciti na Prvu pomoć. Popodne joj je na vrata zakucala policija.

Balić Carevski je kazala da je odnos s Pečarević bio narušen od ranije i da joj je na početku kolegija počela postavljati pitanja vezana za posao, i to odmah povišenim tonom koji je prerastao u viku. Pokušala je odgovoriti, ali ju je Pečarević stalno prekidala. Optužila ju je da laže i da nema što raditi osam sati u danu. Odgovorila je da piše novi priručnik, a ona joj je kazala da je to posao od pola sata. To joj je zazvučalo ponižavajuće i uvredljivo, pozlilo joj je, a onda je čula Pečarević da tadašnjem ravnatelju Stipi Mušuri govori kako će se ona za ovo pobrinuti. Otišla je u ured i nazvala liječnicu, ali je nije uspjela dobiti. Osjećala se sve lošije pa su je prebacili na Hitnu...  

Sud nije prihvatio iskaz oštećenice držeći ga subjektivnim budući da je prvenstveno odraz narušenog odnosa između nje i okrivljenice u dužem vremenskom periodu.  

Sud smatra nesporno utvrđenim da je bilo povišenih tonova, ali sud nije našao dokazanim da bi time bila uznemirena javnost, odnosno, djelatnici ustanove pa nije našao ni dokazanim da su se ostvarila obilježja prekršaja iz članka 13. stavka 1. Zakona o prekršajima protiv javnog reda i mira‘, stoji u presudi.

Branitelj Denis Kulušić zadovoljan je oslobađajućom presudom.

‘Nedvojbeno je utvrđeno da nije došlo do remećenja javnog reda i mira, već se radilo o uobičajenoj komunikaciji unutar javne ustanove. Nije došlo do uznemirenja javnosti, a ni djelatnika ustanove, što su potvrdili gotovo svi saslušani svjedoci pa je bilo za očekivati ovakvu odluku suda‘, kazao je za Dalmatinski portal odvjetnik Kulušić.

Ivošević: Neka, neka

Zamjenik splitskog gradonačelnika Bojan Ivošević jako je zadovoljan zbog ove presude, sudeći po njegovoj Facebook objavi:

- Čisto da vidite s čime se sve susrećemo u obavljanju našeg posla.

Mogu samo iskazati zadovoljstvo zbog ove presude gdje je sud jasno dao do znanja da rukovodeći ljudi imaju pravo uputiti kritiku na (ne)rad nezakonito zaposlenih osoba, te da lažne prijave dotičnih neće prolaziti, već da se trebaju uhvatiti posla.

JU PŠ Marjan nastavit će racionalizirati i unaprijeđivati svoj rad, a jedan od prvih idućih koraka je nova sistematizacija koja je u petak zaprimljena u gradsku upravu gdje je sad očekuje zakonska procedura koju mora proći prije nego stupi na snagu.
