Prekršajni odjel Općinskog suda u Zadru odbacio je zbog zastare optužbe protiv 42-godišnjeg pirotehničara iz Osijeka B.P. koji je proglašen krivim jer je 2017. godine ručnim detektorom metala i pipalicom 'aljkavo' razminirao poljoprivredno zemljište u Zemuniku Gornjem pokraj Zadra.

Za njim je ostalo 20 neiskopanih metalnih predmeta što je utvrdila inspekcija za humanitarno razminiranje Ministarstva unutarnjih poslova.

Nakon njegove žalbe Visoki Prekršajni sud prošle je godine tu presudu ukinuo, te je vratio spis na ponovno odlučivanje. Općinski sud u Zadru spis je dobio 12. listopada 2020., no, međutim, u predmetu je nastupila zastara 15. siječnja ove godine

- Sud je rješavajući u redovnom postupku, a pazeći po službenoj dužnosti, našao da je od dana kada je prekršaj počinjen, prekršaj je počinjen dana 15. siječnja 2017. godine, proteklo vrijeme od četiri godine, dakle vrijeme predviđeno u čl. 13. st. 1. Prekršajnog zakona koji propisuje da prekršajni progon zastarijeva nakon četiri godine - navodi se u presudi sutkinje Senke Vrdoljak.

Pirotehničar je u obrani opovrgnuo krivnju navodeći kako poslove razminiranja tijekom radnog vijeka obavlja savjesno i maksimalno brižljivo poštujući sva pravila struke u prvom redu zbog svoje sigurnosti i sigurnosti kolega, a konačno i radi prevencije svih građana RH. Naveo je kako ne postoje nikakvi dokazi iz kojih bi proizlazilo da su navedeni predmeti bili uopće nađeni. Također, nema fotografija niti bilo kojeg drugog relevantnog dokumenta iz kojih bi proizlazila istinitost tvrdnji iznijetih u prekršajnom nalogu.

Sud je u dokaznom postupku ispitao zaposlenika Hrvatskog centra za razminiranje koji je kontrolirao posao pirotehničara. On je ispirčao je kako je na spornom terenu pronašao 20 neiskopanih metalnih predmeta na površini koja je obuhvaćena izvedbenim planom, što je vidljivo iz rješenja gdje je naloženo da se ista površina ponovno razminira. Pojasnio je kako se prilikom kontrole kvalitete razminiranja pazi da se ne ide na štetu samih pirotehničara, te da se, ukoliko je nešto sporno, mjeri i sama dubina na kojoj su nađeni neiskopani metalni predmeti.

U sudskom postupku je bila je međutim sporna činjenica jesu li se pronađeno metalni dijelovi našli na površini koja je određena izvedbenim planom razminiranja. Utvrđeno je da jesu zbog čega je sud nedvojbeno utvrdio da su se u ponašanju okrivljenog ostvarila obilježja djela prekršaja koje mu se stavlja na teret.

Prekršajni odjel Općinskog suda u Zadru odbacio je zbog zastare optužbe protiv 42-godišnjeg pirotehničara iz Osijeka B.P. koji je proglašen krivim jer je 2017. godine ručnim detektorom metala i pipalicom 'aljkavo' razminirao poljoprivredno zemljište u Zemuniku Gornjem pokraj Zadra.

Za njim je ostalo 20 neiskopanih metalnih predmeta što je utvrdila inspekcija za humanitarno razminiranje Ministarstva unutarnjih poslova.

Nakon njegove žalbe Visoki Prekršajni sud prošle je godine tu presudu ukinuo, te je vratio spis na ponovno odlučivanje. Općinski sud u Zadru spis je dobio 12. listopada 2020., no, međutim, u predmetu je nastupila zastara 15. siječnja ove godine

- Sud je rješavajući u redovnom postupku, a pazeći po službenoj dužnosti, našao da je od dana kada je prekršaj počinjen, prekršaj je počinjen dana 15. siječnja 2017. godine, proteklo vrijeme od četiri godine, dakle vrijeme predviđeno u čl. 13. st. 1. Prekršajnog zakona koji propisuje da prekršajni progon zastarijeva nakon četiri godine - navodi se u presudi sutkinje Senke Vrdoljak.

Pirotehničar je u obrani opovrgnuo krivnju navodeći kako poslove razminiranja tijekom radnog vijeka obavlja savjesno i maksimalno brižljivo poštujući sva pravila struke u prvom redu zbog svoje sigurnosti i sigurnosti kolega, a konačno i radi prevencije svih građana RH. Naveo je kako ne postoje nikakvi dokazi iz kojih bi proizlazilo da su navedeni predmeti bili uopće nađeni. Također, nema fotografija niti bilo kojeg drugog relevantnog dokumenta iz kojih bi proizlazila istinitost tvrdnji iznijetih u prekršajnom nalogu.

Sud je u dokaznom postupku ispitao zaposlenika Hrvatskog centra za razminiranje koji je kontrolirao posao pirotehničara. On je ispirčao je kako je na spornom terenu pronašao 20 neiskopanih metalnih predmeta na površini koja je obuhvaćena izvedbenim planom, što je vidljivo iz rješenja gdje je naloženo da se ista površina ponovno razminira. Pojasnio je kako se prilikom kontrole kvalitete razminiranja pazi da se ne ide na štetu samih pirotehničara, te da se, ukoliko je nešto sporno, mjeri i sama dubina na kojoj su nađeni neiskopani metalni predmeti.

U sudskom postupku je bila je međutim sporna činjenica jesu li se pronađeno metalni dijelovi našli na površini koja je određena izvedbenim planom razminiranja. Utvrđeno je da jesu zbog čega je sud nedvojbeno utvrdio da su se u ponašanju okrivljenog ostvarila obilježja djela prekršaja koje mu se stavlja na teret.

Zadarski sud zbog zastare odbacio optužbe protiv pirotehničara da je nemarno razminirao poljoprivredno zemljište u Zemuniku. ‘Zaboravio‘ 20 mina!

Prekršajni odjel Općinskog suda u Zadru odbacio je zbog zastare optužbe protiv 42-godišnjeg pirotehničara iz Osijeka B.P. koji je proglašen krivim jer je 2017. godine ručnim detektorom metala i pipalicom 'aljkavo' razminirao poljoprivredno zemljište u Zemuniku Gornjem pokraj Zadra.

Za njim je ostalo 20 neiskopanih metalnih predmeta što je utvrdila inspekcija za humanitarno razminiranje Ministarstva unutarnjih poslova.

Nakon njegove žalbe Visoki Prekršajni sud prošle je godine tu presudu ukinuo, te je vratio spis na ponovno odlučivanje. Općinski sud u Zadru spis je dobio 12. listopada 2020., no, međutim, u predmetu je nastupila zastara 15. siječnja ove godine

- Sud je rješavajući u redovnom postupku, a pazeći po službenoj dužnosti, našao da je od dana kada je prekršaj počinjen, prekršaj je počinjen dana 15. siječnja 2017. godine, proteklo vrijeme od četiri godine, dakle vrijeme predviđeno u čl. 13. st. 1. Prekršajnog zakona koji propisuje da prekršajni progon zastarijeva nakon četiri godine - navodi se u presudi sutkinje Senke Vrdoljak.

Pirotehničar je u obrani opovrgnuo krivnju navodeći kako poslove razminiranja tijekom radnog vijeka obavlja savjesno i maksimalno brižljivo poštujući sva pravila struke u prvom redu zbog svoje sigurnosti i sigurnosti kolega, a konačno i radi prevencije svih građana RH. Naveo je kako ne postoje nikakvi dokazi iz kojih bi proizlazilo da su navedeni predmeti bili uopće nađeni. Također, nema fotografija niti bilo kojeg drugog relevantnog dokumenta iz kojih bi proizlazila istinitost tvrdnji iznijetih u prekršajnom nalogu.

Sud je u dokaznom postupku ispitao zaposlenika Hrvatskog centra za razminiranje koji je kontrolirao posao pirotehničara. On je ispirčao je kako je na spornom terenu pronašao 20 neiskopanih metalnih predmeta na površini koja je obuhvaćena izvedbenim planom, što je vidljivo iz rješenja gdje je naloženo da se ista površina ponovno razminira. Pojasnio je kako se prilikom kontrole kvalitete razminiranja pazi da se ne ide na štetu samih pirotehničara, te da se, ukoliko je nešto sporno, mjeri i sama dubina na kojoj su nađeni neiskopani metalni predmeti.

U sudskom postupku je bila je međutim sporna činjenica jesu li se pronađeno metalni dijelovi našli na površini koja je određena izvedbenim planom razminiranja. Utvrđeno je da jesu zbog čega je sud nedvojbeno utvrdio da su se u ponašanju okrivljenog ostvarila obilježja djela prekršaja koje mu se stavlja na teret.
